For the use of the service provided by the Heidelberg website, you should read and obey the Heidelberg Website Service Agreement (hereafter referred to as the “Agreement”). Please read carefully and fully understand the contents of each article, especially the articles that remove or limit the liability, article of jurisdiction and applicable law, and separate agreement and the rules for the use of certain service. Restriction and exception clause may be in the form of a blackbody bold or underlined to prompt you to focus on. Except you have already read and accepted all articles of this Agreement, you have no rights to use the service provided by the Heidelberg. The use of the service of Heidelberg will be deemed that you have already read and accepted to be bound by this Agreement.
Scope of the Agreement
This Agreement is signed between you and Heidelberg concerning that the user uses the relevant services of Heidelberg. “Heidelberg” refers to the Heidelberg China and its branch offices. “User” refers to the people who use the services of Heidelberg, which are called as “you” in this agreement.
The service under this Agreement refers to the products and services provided by Heidelberg including but not limited to product materials, information supplying, technical support, software downloading and after-sales services etc. (hereafter referred to as the “Service”).
The content of this Agreement includes the Heidelberg Website Legal Notice and the User Information and Privacy Protecting Policy at the same time. When you use a certain service of Heidelberg, this service may have other separate agreement or rules etc. (hereafter referred to as the “Separate Agreement”). Once the above content is formally published, it is regarded as the impartible part of this Agreement that you should also comply with. The acceptance of this Agreement means that you all accept the above notice, policy, separate agreement and rules.
Account and Password Security
You may need to register an account when you use the service of Heidelberg.
Heidelberg especially reminds you to keep your account and password properly.Improper safekeeping may lead to the compromise of account and password theft.The responsibility should be at your own risk.
User’s Personal Information Protection
The protection of user’s private information is a fundamental principle of Heidelberg.Heidelberg will collect, use, store and share your personal information according to thisAgreement and the rules of the User Information and Privacy Protecting Policy.
Forms for Using the Agreement
You should use this Service in the way provided or permitted by Heidelberg. The rights acquired base on the Agreement cannot be assigned.
In any occasion, you cannot use this Service in illegal way or ways that violate this Agreement.
Heidelberg will make best effort to provide services to you and ensure the consistency and safety of service; but Heidelberg cannot at all times foresee and prevent the risks of law, technology and other risks, including but not limited to losses and risks of possible
service interruption, data losses caused by force majeure, virus, Trojan virus, hacker attack, unstable system, service defect of third parties, government behavior etc.
You agree that Heidelberg by itself or other parties can send advertisements, promote or propagate information (including without limitation to commercial and non-commercial information) when Heidelberg provides services to you. The means and scope can be modified without special notice to you.
Part of Heidelberg’s services is provided in paid ways. If you use paid service, please obey relevant agreement.
Heidelberg may modify and revise the standard and form of charges for the paid services based on practical situations. In the event that you disagree with aforesaid modification, revision or the payment for the services, you should cease using such services.
You may need to complete the payment through the third party payment platform, and Heidelberg may provide you with the payment access port or link as well, but the payment will be operated by yourself as per the request of the third party payment platform. You shall operate carefully to avoid any loss caused by improper operation. Heidelberg’s acceptance of payment through the third party platform shall not be deemed that Heidelberg provides guarantee in any form for the security and legality of the third party platform, and Heidelberg will not take any legal responsibility that may be generated in the process of your use of the third party platform.
8. 软件 下载 和使用
Software Downloading and Usage
Heidelberg may provide software downloading service. You should use relevant software according to the ways and scope that Heidelberg permits.
Except Heidelberg permits in writing, you cannot engage any of following behaviors:
cancel information relating to the copyright on software and its copies;
reverse engineering, reverse assembly, reverse compile on software or try to find source code of software in other ways;
use, rent, borrow, copy, modify, link, reproduce, assembly, express, publish and build mirror image website etc. on the contents of IPRs owned by Heidelberg;
(4) 对软件或者软件运行过程中释放到任何终端内存中的数据、软件运行过程 中客户端与服务器端的交互数据，以及软件运行所必需的系统数据，进行复制、修改、增加、删除、挂接运行或创作任何衍生作品，形式包括但不限于使用插件、外挂或非经海德堡授权的第三方工具/服务接入软件和相关系统；
copy, modify, add, delete, mount or create derivative works on software or the data that released by the software to any terminal memory during the operation of the software, interactive data between client and server during the operation of the software, and system data that are necessary to the operation of software. The forms include but not limited to the use of plug-in, add-on or access to software and relevant systems by tools/service of third parties unauthorized by Heidelberg;
increase, delete or verify the functions of software or operation effect through modifying or falsifying the instruction or data, or operate or broadcast to the public the software or the methods that are used for the above purposes no matter these behaviors are for the commercial purposes;
The IPRs of the contents provide by Heidelberg (including but not limited to webpage, contexts, pictures, audios, videos, grids) belong to Heidelberg.
Unless special notice provided, all copyrights, patent rights and other intellectual property rights related to the Services shall belong to Heidelberg.
The copyright or trademark of “Heidelberg”, the “Heidelberg” logotype, Saphira, graph and other business marks that are used in the Service provided by Heidelberg shall belong to Heidelberg.
All IPRs of the contents of aforementioned and any other Services are protected by law. Without prior written approval from Heidelberg, no one shall use or create derivative works in any forms.
Illegal Behavior of Users
You shall use the Service in accordance with the laws and regulations and shall not utilize the Service to engage illegal behaviors, including but not limited to:
Publish, deliver, spread, store contents that are harmful to state security and union, sabotaging social stability, violating public morals, insult, slander, obscene, violence and any other contents that violate laws and regulations of state.
Publish, deliver, spread, store contents that infringe intellectual property rights, commercial secrets and other lawful rights of others;
Fiction facts in bad faith, conceal the truth to mislead, cheat others;
Publish, delivery, spread advertisement information and rubbish information;
Other behaviors that are forbidden by laws and regulations.
If you violate the provisions herein and lead to the losses of other parties, you should be responsible for it independently. You should also compensate for the losses suffered by Heidelberg arising therefrom.
Force Majeure and Other Reliefs
11.1 在使用本服务的过程中，可能会遇到不可抗力等风险因素，使本服务发生中断或终止。 不可抗力是指不能预见、不能克服并不能避免且对一方或双方造成重大影响的客观事件，包括但不限于自然灾害如洪水、地震、瘟疫流行和风暴等以及社会事件如战争、动乱、政府行为等。 由于不可抗力给您造成的损失，海德堡在法律允许的范围内免责。
The Service may be suspended or terminated due to the risks such as force majeure during the usage of the Service. Force majeure refers to the objective events that are unforeseeable, insurmountable and unavoidable and that incur serious influence on one of or both parties, including but not limited to natural disasters, such as flood, earthquake, pestilence and hurricanes and storms etc. and social events such as wars, turmoil and government behaviors etc. Regarding to the losses caused because of force majeure, Heidelberg assume liability within the scope prescribed by law.
Within the scope prescribed by law, Heidelberg shall not bear the liability for interruption or suffocation caused by following circumstances:
attacked by computer virus, Trojan virus and other malicious program and hacker;
fault occurred on the computer software, system, hardware and telecommunication line of user or those of Heidelberg;
inappropriate operation of user;
the Service used in a way unauthorized by Heidelberg.
other circumstances that Heidelberg cannot control or reasonably foresee.
Enforcement and Modification of the Agreement
The use of the service of Heidelberg will be deemed that you have already read and accepted to be bound by this Agreement.
Heidelberg has the right to modify the articles of this Agreement when necessary. You will be deemed to accept the modified agreement if you continue to use the software or service provided by Heidelberg after the modification hereof. If you do not accept the modified agreement, you should stop using the software or services provided by Heidelberg.
Jurisdiction and Applicable Law
The establishment, validity, performance, interpretation and dispute settlement shall be governed by the laws of People's Republic of China (not include conflict law).
Any controversy or dispute between you and Heidelberg shall be firstly settled through friendly consultation. In the event of failure of such consultation, you agree to submit the controversy or dispute to the People’s Court of Beijing Chaoyang District.
